台湾地区“物权法”新修正之评述

摘要:台湾地区“立法院”于2010年1月5日修正了“民法”用益物权和占有章。用益物权和占有章所修正的内容体现了法律现代化的要求。在用益物权章，修订了地上权的规定，鉴于土地立体利用之需要，增订区分地上权；废除永佃权的规定，增订农育权的规定；地役权章的修正非常大，鉴于需役及供役之客体已经从土地扩张至其它不动产，为符合这一变化，将“地役权”之章名修正为“不动产役权”；此外，关于占有的修正，增订了占有权利推定之例外规定；修正动产善意取得制度等。Abstract:The new amendments of the real rights law embody the modernization of laws. Regulations on usufructuary rights and possession rights were revised, and differentiation of the rights of superficies was added based on the spatial needs of land; the regulations on the lease in perpetuity were abolished, and regulations on the right to use other people’s land for farming were added; the chapter Land Servitude was changed into Real Property Servitude, because the object for the praedium dominans and praedium serviens has expanded from land to the other real property.In addition, in the amendments on possession, exception regulations about presumption of possession rights were added, and the system of bona fide acquisition of movables was also revised.
